MY STORY

This is the culmination of nearly nine years of working tirelessly to prove my innocence on charges of child abuse.

 

I was offered a plea bargain, which would have reduced my sentence massively.

 

I rejected the plea bargain, as I did not do any of the things I was accused of and my faith would not allow me to lie before God.

 

These were very frustrating years for me, in which, time after time, my petitions and appeals were all rejected, one after another, by the various district courts in Montana and the Montana Supreme Court.

 

There were huge anomalies in the case and yet no one seemed to be listening.

 

Until in 2014, the Federal Defenders of Montana, were appointed to my case and filed a Petition for Habeus Corpus on my behalf, in the Billings Division of Montana, on 22 September of the same year.

My petition for habeas corpus was rejected, much to the surprise of the Assistant Federal Defender himself, who believed I should have been given a hearing on these claims.  

 

He and I appealed my case to the Ninth Circuit Court of Appeals in California in 2016.

 

In April 2017, The Ninth Circuit Court of Appeals granted a certificate of appealability (COA) on four issues in my case.

 

(1) whether one of the jurors in my trial was biased;

 

(2) whether my trial lawyer performed ineffectively in failing to challenge and remove the biased juror;

 

(3) whether my trial lawyer was ineffective in failing to adequately cross-examine the state's witnesses; and

 

(4) whether my trial lawyer's errors, viewed cumulatively, deprived me of a fair trial.  

 

And that is all I want.
